Q: Can I use my account for commercial purposes ?
A: Yes, you can use your account for commercial purposes. The World Wide Web has become a most efficient and cost-effective means of making information available to the users of the internet community. If desired, secure processing is available under domain plan #2 which provides an environment whereby payment information (such as a credit card number) can be transmitted from web browser to web server in an encrypted mode.

Q: What is Graphic Traffic's policy on adult content?
A: Graphic Traffic will not host adult content. With the current state of flux in privacy law and copyright law, we no longer feel it is an appropriate business opportunity for Graphic Traffic, nor is it in keeping with our business mission.

Q: Can I sublease, sell or give away Graphic Traffic's web space to other people once my account is set up?
A: Graphic Traffic's policies restrict customers from subhosting, such as www.domain.com/client. Web accounts are intended for a single web site. You may not sell, sublease, or give away Graphic Traffic's server space other than small advertisements. However, we do provide a Resale Program that provides you and your clients an affordable and preferable alternative. Please check out our Resale Program.

Q: Please explain unsolicited email or Spam? What are Graphic Traffic's policies regarding unsolicted email or Spam?
A: There are several definitions that can be found. Here is how we define it:

  1. The sending of unsolicited e-mail.
  2. Posting commercial ads to USENET newsgroups that do not permit it.
  3. Posting articles containing binary encoded data to a non-binary newsgroup.
  4. Posting off-topic messages to newsgroups.
  5. Excessive Cross-Posting.

We will look into each occurrence of report Spam. If it is your first offense, and your Spam is not too great (maybe you just didn't know better), we will send you a warning e-mail. If this is regarding USENET, we may cancel your messages. If it is not your first offense or it is quite clear you knew what you were doing, you will be subject to the following:

  • Immediate suspension of your account.
  • Possible termination of account.
  • No refund for cancelled accounts due to violation of our SPAM policy.

Q: What are the penalties for copyright infringement?
A: Under federal copyright law, the civil penalties for copyright infringement can be severe, including substantial monetary damages, injunctive relief, and liability for attorneys' fees incurred in prosecuting a case. If a court determines that the infringement was committed willfully, statutory damages of up to $100,000 for each sound recording infringed can be awarded. Even if not found to be acting willfully, a defendant can still be held liable for statutory damages of $500 to $20,000 for each sound recording copyright infringed. It is important to remember that these penalties apply even if money was not charged. In addition, criminal penalties may be imposed if someone wilfully infringes a copyrighted work for commercial advantage or private financial gain. Q: What constitutes software piracy?
A: Generally, if you have to pay for software, and you didn't, then it's piracy. This can be in the form of:

a friend giving you software to try
making a 'backup' of your office software for your home computer
downloading it from somewhere on the net
buying a compilation cd at a swapmeet
buying one copy for the office, but using it on multiple workstations etc.

If in doubt, pay for the software, and read the license agreement for more details on the number of instances or machines you can run it on. You are responsible for the software you use.

Q: What happens if I allow people to download pirated software from my site?
A: Graphic Traffic checks all sites periodically for the existence of software downloads as well as to check server log files for MBs transmitted. If we find that your account is in violation, it will be cancelled without recourse for refund, and your account information might be handed over to the BSA for further investigation and legal procedings. If your site links to other sites that allow downloads of illegal software, your account is subject to suspension and cancellation until links are removed. The use of a disclaimer on your page to the effect of "I am not held responsible for the content downloaded from this site" is not protection from personal accountability of the software downloaded from your site.
